1) Term of the Agreements:
The term of this affiliate agreement between you and Zymetrical
(through MyZymetrical.com, and Zymetrical.com) will begin upon
acceptance of your affiliate application and will end upon the
termination by either party. Either party is able to terminate this
agreement at any time, with or without cause. You will only be
eligible to earn referral commissions on sales occurring during the
set term.
Zymetrical agrees to:
- Pay each affiliate 10% (or more
depending on agreed upon sum), less shipping costs, for each
verifiable sale originating through Zymetrical.com,
MyZymetrical.com, or other Zymetrical properties, as agreed upon
at the time you are accepted into our affiliate program.
- Pay
each affiliate in a timely manner once the minimum payout amount
has been reached, through agreed upon payment methods, in the
agreed upon time frame.
Affiliate agrees:
- To advertise Zymetrical and it's
products and services in a fair manner, without the use of spam,
in return for an agreed upon percentage of revenues from each sale
generated through said affiliate.
- Not to compete with Zymetrical,
directly or indrectly, through the use or operation of websites
similar to Zymetrical.com, or other Zymetrical properties.
- Not to bid on keywords currently in
use by Zymetrical through cpc services such as Google Adwords and
overture, among others, or to intentionally interfere with current
Zymetrical.com advertising campaigns.
2) Limitation of Liability:
We will not be liable for indirect, special or consequential damages,
or any loss of revenue, profits or data, arising in connection with
this agreement or the program, even if we have been advised of the
possibility of such damages.
3) Spam, Fraud: Any and all affiliates
caught participating in spam or other questionable practices will be
terminated immediately, without recourse.
4) Miscellaneous: You acknowledge that you have read and
agree to all of the terms and conditions of this agreement. You
understand that at any time we may solicit referrals of other websites
or operate web sites that may compete with your web site.
Zymetrical reserves the right to monitor sites at any time to ensure
that they are compliance with our guidelines. We reserve the
right to terminate any agreement at any time, at our sole discretion,
if we feel that your site is unsuitable for this program.
Zymetrical reserves the right to
change, update, or modify these terms at any time. You will be
notified in such an instance.
